A high court ruling has found Tesco guilty of copying Lidl’s logo to promote its clubcard loyalty scheme.
The judge found that Tesco had infringed Lidl’s trademark and had been misleading shoppers into thinking clubcard prices were the same or lower than at Lidl.
Lidl said it was particularly concerned as Tesco price matches against Aldi under its “Aldi Price Match” campaign. The clubcard logo often appeared alongside the Aldi Price Match logo and Lidl said it was likely customers would be mistaken into believing Tesco was price matching against Lidl as well as Aldi.
Lidl brought the court action against Tesco in December 2020, asking the court to order Tesco to stop using the logo.
Retail Systems has reached out to Tesco for comment.
Lidl claimed it is consistently cheaper than Tesco and cited research by Which?, which found the average price gap is over £9 when comparing similar baskets of goods.
Commenting on the news, a Lidl GB spokesperson said: “Over the last three years, Tesco has been using its Clubcard logo to deceive many customers into believing that Tesco was price matching against Lidl or was able to offer the same great value as us.”
They added: “This infringement allowed Tesco to take unfair advantage of our longstanding reputation for great value, misleading their customers at a time when they should have been supporting them.”
